2. Acceptance of These Terms
By using the Channel Database website or services, you confirm that you have read, understood, and agree to be bound by these Terms of Use and any applicable order form, quotation, service agreement, license agreement, or other written agreement between you and Channel Database.

5. B2B Data License and Permitted Use
Unless a separate written agreement states otherwise, data, reports, spreadsheets, contact records, and other datasets supplied by Channel Database are provided to the purchasing customer under a limited business-use license.

Subject to these Terms and applicable law, customers may use purchased data for legitimate internal business purposes such as:

Unless expressly authorized in writing by Channel Database, you may not use, resell, redistribute, publish, sublicense, or otherwise exploit purchased data in a manner that violates these Terms or applicable law.
Prohibited activities include:

- ✕ Republishing substantial portions of the database
- ✕ Making the database publicly downloadable
- ✕ Sublicensing access to unauthorized third parties
- ✕ Using the data for unlawful activities
- ✕ Using the data to facilitate fraud or deception
- ✕ Attempting to circumvent access controls
- ✕ Misrepresenting Channel Database as the source of your own service
7. Customer Responsibility for Marketing and Outreach
Customers are responsible for determining whether their use of Channel Database data complies with applicable laws and regulations governing email marketing, telephone marketing, direct marketing, privacy, telecommunications, consumer protection, and electronic communications.
Important
Purchasing or receiving data from Channel Database does not guarantee that a particular marketing activity is lawful in every jurisdiction. Customers must independently assess applicable requirements before contacting individuals or organizations.
8. Data Accuracy and Verification
We make reasonable efforts to maintain accurate and relevant business information. However, business information can change frequently. Companies may change employees, job titles, email addresses, telephone numbers, technologies, services, ownership, or business status.
Unless a specific written agreement provides otherwise, Channel Database does not guarantee that every individual record will remain accurate or complete after delivery.
We use reasonable processes to maintain business information.
Data may be reviewed and updated through our internal processes.
Customers may report material data issues for review.
9. Orders, Quotes, and Custom Data
Prices, quantities, geographic coverage, data fields, delivery formats, timelines, and other requirements may be specified in a quotation, order confirmation, invoice, statement of work, or separate written agreement.
If a written customer agreement conflicts with these Terms, the specific written agreement will control to the extent of the conflict.
10. Pricing and Payment
Applicable prices will be communicated before an order is confirmed. Unless otherwise agreed in writing, invoices are payable according to the payment terms stated on the applicable invoice or order.
Customers are responsible for applicable taxes, duties, banking charges, or other governmental charges associated with their purchase, except taxes imposed on Channel Database's net income.
11. Refunds, Cancellations and Duplicate Payments
Because Channel Database provides digital B2B data, reports, contact databases, research, and customised datasets that may be prepared or delivered specifically for a customer, purchases are generally non-refundable once the requested data, report, or service has been delivered or made available to the customer, except where a refund is required by applicable law or expressly agreed in writing by Channel Database.
No-Refund Policy
We encourage customers to review the proposed scope, geographic coverage, company criteria, contact requirements, pricing, and delivery details before confirming an order. Once a digital dataset, report, or customized service has been delivered or made available, the order is generally final and cannot be cancelled or refunded.
This policy helps us maintain the integrity of our data products and reflects the fact that digital datasets and customized research cannot practically be returned after delivery or access has been provided.

Duplicate or Double Payments
If a customer accidentally makes two or more payments for the same order, please contact us as soon as possible with the relevant payment or order information.
Where we confirm that a duplicate payment has been made for the same order, the additional amount will normally be issued as a Channel Database data credit rather than a cash refund.
Equal to Duplicate Payment
The confirmed duplicate payment amount will be credited toward a future Channel Database data purchase.
12 Months
The credit may be used within twelve months from the date the duplicate payment is confirmed.
Easy to Apply
The credit may be applied toward an eligible future Channel Database data, report, or research order.
Example: If an order is accidentally paid twice and the second payment is confirmed as a duplicate, the value of the additional payment will be recorded as a Channel Database credit. The customer may use that credit toward an eligible future order within 12 months.
Data Quality and Service Issues
Our no-refund policy does not prevent customers from reporting material data-quality issues or service problems. Where a specific order includes an accuracy guarantee, replacement policy, correction commitment, or other written service-level commitment, we will handle the issue according to the applicable order or written agreement.

Appropriate Remedy

Nothing in this Refund and Cancellation Policy is intended to exclude, restrict, or override any refund, cancellation, withdrawal, warranty, statutory remedy, or other right that cannot lawfully be excluded or limited under the laws applicable to the customer or transaction.

Unless expressly stated otherwise, Channel Database and its licensors retain all rights, title, and interest in the website, software, database structure, database compilation, reports, rankings, research methodology, designs, graphics, trademarks, logos, written content, and other proprietary materials.
Your license does not transfer ownership
Purchasing a report or dataset does not transfer ownership of Channel Database's underlying database, database structure, proprietary methodology, intellectual property, or other proprietary rights unless expressly agreed in writing.
13. Website Content and Rankings
Information published on the Channel Database website may include rankings, company profiles, category pages, research, statistics, industry observations, comparisons, descriptions, and other informational material.
Such information is provided for general business and informational purposes and should not be treated as a guarantee of future business performance, financial results, technology performance, or commercial success.
14. Third-Party Information
Some information made available through Channel Database may originate from third-party or publicly available sources.
We may combine, organize, normalize, verify, enrich, or otherwise process information from multiple sources. We do not control all third-party sources and cannot guarantee their continued availability or accuracy.

You agree not to misuse our website, systems, content, or services.
16. Account and Access Security
If Channel Database provides you with an account, login credentials, download access, or other restricted access, you are responsible for maintaining the confidentiality of your credentials.
You must promptly notify us if you believe your account or credentials have been compromised or used without authorization.

Each party may receive confidential information belonging to the other party in connection with a business relationship. Confidentiality obligations do not apply to information that is publicly available through no breach of obligation, was already lawfully known, is independently developed, or is lawfully received from another source without a confidentiality obligation.

21. Limitation of Liability
To the maximum extent permitted by applicable law, Channel Database will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, business opportunities, goodwill, or anticipated savings arising from the use of our website or services.
Where permitted by applicable law, Channel Database's aggregate liability arising from a particular purchase or service will not exceed the amount paid by the customer for the specific service giving rise to the claim during the applicable period.
These limitations do not apply to liability that cannot legally be excluded or limited, including where applicable liability arising from fraud, intentional misconduct, or other matters that applicable law does not permit us to limit.
22. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold Channel Database and its officers, employees, contractors, and service providers harmless from claims, losses, liabilities, damages, costs, and reasonable expenses arising from your unlawful use of our services, violation of these Terms, misuse of purchased data, or infringement of another party's rights.
This provision does not apply to the extent that a claim results from Channel Database's own unlawful conduct or liability that cannot legally be shifted to you.
23. Suspension or Termination
We may suspend or terminate access to our website or services where reasonably necessary to protect our systems, enforce these Terms, prevent fraud or misuse, comply with legal obligations, or address non-payment.
If access is terminated because of a material breach of these Terms, any applicable data license may also terminate unless otherwise agreed in writing.
Provisions concerning intellectual property, confidentiality, payment obligations, permitted data use, liability, dispute resolution, and other provisions intended to survive termination will continue to apply where appropriate.
24. Force Majeure
Channel Database will not be responsible for delays or failures caused by circumstances beyond our reasonable control, including natural disasters, war, terrorism, governmental action, labor disputes, telecommunications failures, internet outages, power failures, cyber incidents, infrastructure failures, or failures of third-party providers.
25. Governing Law and Disputes

27. Electronic Communications
When you communicate with Channel Database electronically, including by email, website forms, or other digital channels, you consent to receiving electronic communications relating to your enquiries, orders, account, transactions, and services.
Marketing communications are subject to applicable privacy and electronic-marketing requirements and may be unsubscribed from as described in our Privacy Policy.
28. Severability
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be interpreted or modified to the minimum extent necessary to make it enforceable, where permitted by law.
The remaining provisions will continue in full force and effect.
